Purchase terms and conditions

These General Terms and Conditions of Purchase regulate the use of the simoncoll.com website (hereinafter "the website") owned by Chocolates Simón Coll, S.A. (hereinafter Simón Coll). Chocolates Simón Coll, S.A. is a public limited company with registered office at Calle Sant Pere, 37, Sant Sadurní d'Anoia, Spain, with tax identification number A-08720781, and registered in the Barcelona Mercantile Register, page 52473, Folio 119, Volume 4769, Book 4090, Section 2, Incs.1ª, one of its commercial brands being Simón Coll. The use by the customer of the services of the Simón Coll online shop presupposes, in all cases, adherence to the General Purchasing Conditions in the version published by Simón Coll at the time of the purchase order. It is therefore advisable for the customer to read these General Conditions before proceeding with the purchase.

1) Scope of the contract

These General Conditions of Purchase apply to the sale of all Simón Coll products through its website, to consumers to whom orders can be delivered in Spanish territory (except for the Canary Islands, Ceuta, and Melilla), Portugal, and foreign countries (except for Thailand, China, Peru, Panama, Russia, India, and South Africa). The list of these foreign countries where we do not ship could be increased during our activity. Simón Coll informs that its website is exclusively aimed at an audience over 18 years of age. Simón Coll reserves the right to cancel a customer's access account if fraudulent, speculative, or bad faith acts are detected in the use of this service. In the same way, Simón Coll reserves the right to cancel a customer's access account if they maintain debit or unpaid balances.

2) Prices and products

The applicable prices are those indicated on the website on the date of the order. The prices are detailed on each item and include VAT (Value Added Tax). The shipping cost is indicated to the customer in detail at the time of placing the order. The prices on the website are indicated in euros. These prices, unless expressly stated otherwise, do not include shipping costs, shipping insurance, or any other additional services and annexes to the product.

The presentation of the products with their characteristics and images are those indicated in the product descriptions. Simón Coll reserves the right to unilaterally modify, at any time and without prior notice, the prices of the products, as well as to suspend or cancel their sale temporarily or definitively.

3) Purchasing process

First of all, it is necessary to specify that purchases made on the website are subject to the availability of the product. The process for purchasing products through the website is as follows:

3.1. Shopping basket

All the products selected by the user will be added to his/her "Shopping Basket". The user must access the shopping basket to start the purchase process. To carry out the purchase process, the user can either register or make the purchase as a guest user with his/her e-mail address. In the case of registration, the user must enter their username and password to access their account. All the information necessary to make the purchase (payment details and delivery of the order) will appear there, which will have been previously filled in when registering. These data will be stored in such a way that, every time you make a purchase, these data will appear automatically. They can be modified at any time. If the user prefers not to register, he/she will have to indicate these data during the purchase process without having to have an account.

3.2. User registration

To create an account, the user must go to "log in" and click on "receive access code by e-mail". A code will be sent to the e-mail address provided, which must be entered in the same box. Once you have followed these steps, you will be able to access your account. To create your password, go to the authentication section and set your password. From there, you will be able to access with your email address and password.

3.3. Delivery Options

Once the user enters their delivery address, the system will display the delivery costs (see details in section "5. Deliveries: Forms, Delivery Times and Delivery Costs") and an estimated delivery time. No deliveries will be made on Saturdays, Sundays, and public holidays. For more information on delivery times, see "5. Deliveries: Forms, Delivery Times and Shipping Costs".

3.4. Payment

The user chooses the method of payment and accepts the operation by giving his consent. See more information in section "4. Methods of Payment".

3.5. Acceptance

The user confirms the order and accepts the purchase of the selected products, as well as the Terms and Conditions of Purchase and the Privacy Policy.

3.6. Confirmation of purchase

The user receives, at the email address provided, a communication specifying the characteristics of the product, price (broken down), shipping method, date of purchase, order number and expected delivery date. 4) Payment methods

The payment will be made at the end of the purchase process and will be an indispensable condition for the formalization of the order. Under no circumstances may payment be made later. Payment by means of deferred procedures such as cash on delivery, transfer, or payment in-store at the time of picking up of the order is not allowed. The means of payment accepted are debit or credit cards (Visa® or MasterCard®) and the PayPal system. If payment is made by credit card, the amount of your order will be blocked and will not be charged or deducted from your credit until the order has been shipped. If payment is made by debit card, the charge will be made automatically at the time of purchase. In any case, the choice of payment method is made during the checkout process on the corresponding screen. The customer must notify Simón Coll of any undue or fraudulent charge on the card used for purchases, by e-mail (chocolates@simoncoll.com) or by telephone (93.891.11.00), as soon as possible so that Simón Coll can take the appropriate steps. The suppliers or issuers of means of payment may adopt anti-fraud measures that involve the rejection of certain types of operations. Simón Coll is not responsible for the application of this type of security policy.

5) Deliveries: delivery methods, times and shipping costs

Purchases made on the Simón Coll website cannot be delivered to post office boxes, they will always be delivered either to the address and the person indicated at the time of purchase confirmation of the product or they will be picked up at the Espai Xocolata store in Sant Sadurní d'Anoia (Calle Sant Pere, 37 - 08770) or our Chocolate Amatller store located in Barcelona (Provença, 269 - 08008).

Simón Coll is not responsible if the delivery of the order cannot be completed because of inaccurate or false information provided by the user for this purpose, as well as if the delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.

Simón Coll is not responsible for delays in the delivery of orders due to problems derived from the transport company, such as inclement weather, strikes, or during vacation periods or local holidays.

The delivery time of an order should be estimated within 48 hours, depending on the day and time of confirmation. Deliveries will only be made from Tuesday to Friday excluding holidays. More specifically:

  • Orders placed from Monday to Thursday before 12:00 am, delivery will be within 48 hours.

  • Orders placed from Monday to Wednesday after 12:00 am will be delivered within 48-72 hours.

  • Orders placed on Thursday after 12:00 am, Friday, Saturday, or Sunday will be delivered the next Wednesday.

  • During the Christmas campaign, deliveries are not guaranteed within 48-72 hours due to possible saturation of the courier service.

  • Deliveries to the Balearic Islands will have a delivery time of 48-72 hours excluding holidays.

  • Deliveries to the Canary Islands, Ceuta, and Melilla will not be made.

  • Deliveries to Peninsula (Spain) and Balearic Islands will be made before 14 hours.

    Delivery times are maintained for those orders that are picked up at the store.

    Shipping costs are 4,95€ for the whole Peninsula (Spain and Portugal) and Balearic Islands. There will be no additional shipping costs for orders that are picked up at the store.

    If at the time of delivery the customer is not at the address indicated, the carrier will contact him (via telephone or leave a note for him to contact the transport agency). In this way, we will try to coordinate a second delivery the next day. In Simón Coll we have organized the logistics of deliveries so that the product travels in the best conditions, so it is important to receive the order in the first delivery (24h), not being able to be responsible for the state of the product after two days from the expected delivery and without the customer can claim a refund of the purchase.

6) Order tracking

The user will receive an e-mail with the confirmation of the order, the order number, and the expected delivery date. From the website, you will be able to track your order in the "My Account" section. In the "Pending Order" section, the status of the order will be shown. It may be "In Process", in which case the order is being processed and has not been delivered to the carrier, or it may be "Completed” when it has been delivered to the carrier. When the order has already been delivered to the transport agency, the latter will be in charge of contacting the customer and providing a tracking number and the day on which the delivery will be made.

In the "Order History" section, the list of previous purchases will be shown to the user.

7) Product availability

In the event that Simón Coll cannot serve the customer the products already purchased and paid for lack of availability at that time, it will inform the customer as soon as possible, who may choose to make an exchange for another available product of the same or similar amount. The customer is also entitled to request a refund for the number of unavailable products. Simón Coll must make the refund effective within a maximum period of 30 days and by the same means of payment with which the payment was made.

8) Refund and cancellation policy

The Customer may cancel his order without giving any reason within 14 calendar days of delivery of the Products purchased. In the case of having purchased more than one Product, the period shall be counted from the day on which the last of the Products in the order has been delivered. This right shall not apply in the event that the Product has been manufactured according to the specifications provided by the Customer and is therefore a customized Product.
